가족관계의 등록 등에 관한 법률 제18조(등록부의 정정)

① 등록부의 기록이 법률상 무효인 것이거나 그 기록에 착오 또는 누락이 있음을 안 때에는 시ㆍ읍ㆍ면의 장은 지체 없이 신고인 또는 신고사건의 본인에게 그 사실을 통지하여야 한다. 다만, 그 착오 또는 누락이 시ㆍ읍ㆍ면의 장의 잘못으로 인한 것인 때에는 그러하지 아니하다.

② 제1항 본문의 통지를 할 수 없을 때 또는 통지를 하였으나 정정신청을 하는 사람이 없는 때 또는 그 기록의 착오 또는 누락이 시ㆍ읍ㆍ면의 장의 잘못으로 인한 것인 때에는 시ㆍ읍ㆍ면의 장은 감독법원의 허가를 받아 직권으로 정정할 수 있다. 다만, 대법원규칙으로 정하는 경미한 사항인 경우에는 시ㆍ읍ㆍ면의 장이 직권으로 정정하고, 감독법원에 보고하여야 한다. <개정 2013.7.30>

③ 국가 또는 지방자치단체의 공무원이 그 직무상 등록부의 기록에 착오 또는 누락이 있음을 안 때에는 지체 없이 신고사건의 본인의 등록기준지의 시ㆍ읍ㆍ면의 장에게 통지하여야 한다. 이 경우 통지를 받은 시ㆍ읍ㆍ면의 장은 제1항 및 제2항에 따라 처리한다.
