가족관계의 등록 등에 관한 법률 제75조(협의상 이혼의 확인)

① 협의상 이혼을 하고자 하는 사람은 등록기준지 또는 주소지를 관할하는 가정법원의 확인을 받아 신고하여야 한다. 다만, 국내에 거주하지 아니하는 경우에 그 확인은 서울가정법원의 관할로 한다.

② 제1항의 신고는 협의상 이혼을 하고자 하는 사람이 가정법원으로부터 확인서등본을 교부 또는 송달받은 날부터 3개월 이내에 그 등본을 첨부하여 행하여야 한다.

③ 제2항의 기간이 경과한 때에는 그 가정법원의 확인은 효력을 상실한다.

④ 가정법원의 확인 절차와 신고에 관하여 필요한 사항은 대법원규칙으로 정한다.
