개인정보 보호법 제48조(조정의 거부 및 중지)

① 분쟁조정위원회는 분쟁의 성질상 분쟁조정위원회에서 조정하는 것이 적합하지 아니하다고 인정하거나 부정한 목적으로 조정이 신청되었다고 인정하는 경우에는 그 조정을 거부할 수 있다. 이 경우 조정거부의 사유 등을 신청인에게 알려야 한다.

② 분쟁조정위원회는 신청된 조정사건에 대한 처리절차를 진행하던 중에 한 쪽 당사자가 소를 제기하면 그 조정의 처리를 중지하고 이를 당사자에게 알려야 한다.
