건설산업기본법 제66조(보증금 징수의 제한)

보증채권자는 공제조합이 조합원의 의무 이행을 보증하면 관계 법령 및 계약서 등의 약정에도 불구하고 그 보증서로서 보증금 또는 공사 이행 보증서를 갈음하여야 하고, 그 조합원으로부터 따로 보증금이나 그 밖의 명목의 금액을 받아내서는 아니 된다.
