Employment Insurance Act, Article 118 (Administrative Fines)
①다음 각 호의 어느 하나에 해당하는 사업주, 보험사무대행기관, 노무제공플랫폼사업자의 대표자 또는 대리인ㆍ사용인, 그 밖의 종업원에게는 300만원 이하의 과태료를 부과한다. <개정 2008.12.31, 2019.8.27, 2020.5.26, 2020.6.9, 2021.1.5, 2022.12.31>
(1) An administrative fine not exceeding three million won shall be imposed on a business owner, an insurance affairs agency, or a representative, agent, employee or other worker of a labor platform operator who falls under any of the following:
1. 제15조(제77조의5제1항 및 제77조의10제1항에서 준용하는 경우를 포함한다), 제77조의2제3항 및 제77조의7제1항을 위반하여 신고를 하지 아니하거나 거짓으로 신고한 자
1. A person who fails to make a report, or makes a false report, in violation of Article 15 (including cases where it applies mutatis mutandis under Article 77-5 (1) and Article 77-10 (1)), Article 77-2 (3) or Article 77-7 (1);
2. 제42조제3항 후단(제77조의5제2항 및 제77조의10제2항에서 준용하는 경우를 포함한다)을 위반하여 이직확인서를 발급하여 주지 아니하거나 거짓으로 작성하여 발급하여 준 자
2. A person who fails to issue a certificate of leaving employment, or issues a falsely prepared one, in violation of the latter part of Article 42 (3) (including cases where it applies mutatis mutandis under Article 77-5 (2) and Article 77-10 (2));
3. 제43조제4항 후단(제77조의5제2항 및 제77조의10제2항에서 준용하는 경우를 포함한다)을 위반하여 이직확인서를 제출하지 아니하거나 거짓으로 작성하여 제출한 자
3. A person who fails to submit a certificate of leaving employment, or submits a falsely prepared one, in violation of the latter part of Article 43 (4) (including cases where it applies mutatis mutandis under Article 77-5 (2) and Article 77-10 (2));
4. 제108조제1항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 요구에 따르지 아니하여 보고를 하지 아니하거나 거짓으로 보고한 자, 같은 요구에 따르지 아니하여 문서를 제출하지 아니하거나 거짓으로 적은 문서를 제출한 자 또는 출석하지 아니한 자
4. A person who, failing to comply with a requirement under Article 108 (1) (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)), fails to make a report or makes a false report, fails to submit documents or submits documents containing false statements, or fails to appear;
5. 제108조제2항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 요구에 따르지 아니하여 증명서를 내주지 아니한 자
5. A person who, failing to comply with a requirement under Article 108 (2) (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)), fails to issue a certificate;
6. 제109조제1항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 질문에 답변하지 아니하거나 거짓으로 진술한 자 또는 조사를 거부ㆍ방해하거나 기피한 자
6. A person who fails to answer, or gives a false statement in response to, questions under Article 109 (1) (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)), or who refuses, obstructs or evades an investigation;
7. 제77조의7제2항을 위반하여 자료 또는 정보의 제공 요청에 따르지 아니한 자
7. A person who fails to comply with a request for materials or information in violation of Article 77-7 (2);
8. 제77조의7제5항을 위반하여 노무제공자의 피보험자격의 신고와 관련된 자료 또는 정보를 보관하지 아니한 자
8. A person who fails to keep materials or information related to the report of a labor provider's insured status in violation of Article 77-7 (5).
②다음 각 호의 어느 하나에 해당하는 피보험자, 수급자격자 또는 지급되지 아니한 실업급여의 지급을 청구하는 자에게는 100만원 이하의 과태료를 부과한다. <개정 2008.12.31, 2020.6.9, 2021.1.5, 2022.12.31>
(2) An administrative fine not exceeding one million won shall be imposed on an insured person, an eligible claimant, or a person claiming payment of unpaid unemployment benefits who falls under any of the following:
1. 제108조제3항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따라 요구된 보고를 하지 아니하거나 거짓으로 보고한 자, 문서를 제출하지 아니하거나 거짓으로 적은 문서를 제출한 자 또는 출석하지 아니한 자
1. A person who fails to make a report required under Article 108 (3) (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)) or makes a false report, fails to submit documents or submits documents containing false statements, or fails to appear;
2. 제109조제1항(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 질문에 답변하지 아니하거나 거짓으로 진술한 자 또는 검사를 거부ㆍ방해하거나 기피한 자
2. A person who fails to answer, or gives a false statement in response to, questions under Article 109 (1) (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)), or who refuses, obstructs or evades an inspection.
③제87조(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)에 따른 심사 또는 재심사의 청구를 받아 하는 심사관 및 심사위원회의 질문에 답변하지 아니하거나 거짓으로 진술한 자 또는 검사를 거부ㆍ방해하거나 기피한 자에게는 100만원 이하의 과태료를 부과한다. <개정 2008.12.31, 2020.6.9, 2021.1.5, 2022.12.31>
(3) An administrative fine not exceeding one million won shall be imposed on a person who fails to answer, or gives a false statement in response to, questions from an examiner or the Review Committee conducting a review or re-review upon a request under Article 87 (including cases where it applies mutatis mutandis under Article 77-5 (3) and (4) and Article 77-10 (3) and (4)), or who refuses, obstructs or evades an inspection by them.
④제1항부터 제3항까지의 규정에 따른 과태료는 대통령령으로 정하는 바에 따라 고용노동부장관이 부과ㆍ징수한다. <개정 2010.6.4>
(4) Administrative fines under paragraphs (1) through (3) shall be imposed and collected by the Minister of Employment and Labor as prescribed by Presidential Decree.
