공소청법 제45조(검사의 신분보장과 징계)

① 검사는 탄핵결정, 금고 이상의 형의 선고 또는 징계처분을 받은 경우를 제외하고는 파면되지 아니하며, 징계처분, 적격심사 또는 이 법에서 정하는 사유에 따르지 아니하고는 해임ㆍ면직ㆍ정직ㆍ감봉ㆍ견책 또는 퇴직 처분을 받지 아니한다.

② 검사의 징계에 관한 사항은 따로 법률로 정한다.
