공익신고자 보호법 제12조(공익신고자등의 비밀보장 의무)

① 누구든지 공익신고자등이라는 사정을 알면서 그의 인적사항이나 그가 공익신고자등임을 미루어 알 수 있는 사실을 다른 사람에게 알려주거나 공개 또는 보도하여서는 아니 된다. 다만, 공익신고자등이 동의한 때에는 그러하지 아니하다.

② 위원회는 제1항을 위반하여 공익신고자등의 인적사항이나 공익신고자등임을 미루어 알 수 있는 사실이 공개 또는 보도되었을 때에는 그 경위를 확인할 수 있다. <신설 2015.7.24>

③ 위원회는 제2항에 따른 경위를 확인하는 데 필요하다고 인정하면 해당 공익신고자등이 공익신고등을 한 기관에 관련 자료의 제출이나 의견의 진술 등을 요청할 수 있다. 이 경우 자료의 제출이나 의견의 진술을 요청받은 해당 기관은 특별한 사유가 없으면 그 요청에 협조하여야 한다. <신설 2015.7.24>

④ 위원회는 제1항을 위반하여 공익신고자등의 인적사항이나 공익신고자등임을 미루어 알 수 있는 사실을 다른 사람에게 알려주거나 공개 또는 보도한 사람의 징계권자에게 그 사람에 대한 징계 등 필요한 조치를 요구할 수 있다. 이 경우 요구를 받은 징계권자는 정당한 사유가 없으면 그 요구에 따라야 한다. <개정 2015.7.24, 2024.2.6>
