공직선거법 제110조의2(허위사실 등에 대한 이의제기)

① 누구든지 후보자 또는 예비후보자의 출생지ㆍ가족관계ㆍ신분ㆍ직업ㆍ경력등ㆍ재산ㆍ행위ㆍ장애ㆍ소속단체, 특정인 또는 특정단체로부터의 지지여부 등에 관하여 공표된 사실이 거짓임을 이유로 해당 선거구선거관리위원회를 거쳐 직근 상급선거관리위원회에 서면으로 이의제기를 할 수 있다. <개정 2026.4.22>

② 제1항에 따른 이의제기를 받은 직근 상급선거관리위원회는 후보자 또는 예비후보자, 소속정당, 이의제기자, 관련 국가기관ㆍ지방자치단체, 그 밖의 기관ㆍ단체에 대하여 증명서류 및 관련자료의 제출을 요구할 수 있다. 이 경우 제출요구를 받은 자는 정당한 사유가 없으면 지체 없이 이에 따라야 한다.

③ 직근 상급선거관리위원회는 증명서류 및 관련자료의 제출이 없거나 제출한 증명서류 및 관련자료를 통하여 확인한 결과 공표된 사실이 거짓으로 판명된 때에는 이를 지체 없이 공고하여야 한다. 이 경우 이의제기서와 제출받은 서류ㆍ자료를 「개인정보 보호법」을 위반하지 아니하는 범위에서 편집ㆍ수정 없이 선거관리위원회 홈페이지에 공개하여야 한다.
