공직선거법 제141조(당원집회의 제한)

①정당(당원협의회를 포함한다)은 선거일전 30일부터 선거일까지 소속당원의 단합ㆍ수련ㆍ연수ㆍ교육 그 밖에 명목여하를 불문하고 선거가 실시중인 선거구안이나 선거구민인 당원을 대상으로 당원수련회 등(이하 이 조에서 "당원집회"라 한다)을 개최할 수 없다. 다만, 당무에 관한 연락ㆍ지시 등을 위하여 일시적으로 이루어지는 당원간의 면접은 당원집회로 보지 아니한다. <개정 1995.12.30, 2000.2.16, 2004.3.12, 2010.1.25>

②정당이 선거일 전 90일(선거일 전 90일 후에 실시사유가 확정된 보궐선거등에서는 그 선거의 실시사유가 확정된 때)부터 당원집회를 개최하는 때(중앙당이 그 연수시설에서 개최하는 경우를 제외한다)에는 개최지역을 관할하는 구ㆍ시ㆍ군선거관리위원회에 신고한 후 당해 정당의 사무소, 주민회관, 공공기관ㆍ단체의 사무소 그 밖의 공공시설 또는 다수인이 왕래하는 장소가 아닌 공개된 장소에서 개최하여야 한다. <개정 2004.3.12, 2010.1.25>

③「정치자금법」 제27조(보조금의 배분)의 규정에 의하여 보조금의 배분대상이 되는 정당은 중앙선거관리위원회규칙이 정하는 바에 따라 국가 또는 지방자치단체[제53조(공무원등의 입후보)제1항제4호 또는 제6호에 규정된 기관을 포함한다]가 소유하거나 관리하는 주민회관ㆍ체육관 또는 문화원 기타 다수인이 모일 수 있는 시설이나 장소를 당원집회의 장소로써 무료로 사용할 수 있다. 이 경우 시설의 손괴 또는 전력의 사용 등 재산상의 손실을 끼친 때에는 당해 정당이 보상하여야 한다. <신설 2004.3.12, 2005.8.4>

④제2항의 당원집회 장소의 외부에는 이 법에 의한 당원집회임을 표시하는 표지를 첩부 또는 게시하여야 하되, 그 개최자는 당해 집회종료후에는 지체없이 철거하여야 한다. 이 경우 그 표지에는 후보자가 되고자 하는 자의 사진ㆍ성명 또는 선전구호 기타 후보자가 되고자 하는 자를 선전하는 내용을 게재하여서는 아니된다. <개정 2004.3.12>

⑤제3항의 규정에 의한 사용신청을 받은 공공시설의 관리자는 정당한 사유가 있는 경우를 제외하고는 그 사용을 거부할 수 없다. <신설 2004.3.12>
