공직선거법 제177조(투표함의 개함)

①투표함을 개함하는 때에는 구ㆍ시ㆍ군선거관리위원회위원장은 개표참관인의 참관하에 투표함의 봉쇄와 봉인을 검사한 후 이를 열어야 한다. 다만, 정당한 사유 없이 참관을 거부하는 개표참관인이 있는 때에는 그 권한을 포기한 것으로 보고, 개표록에 그 사유를 기재한다. <개정 2005.8.4>

②구ㆍ시ㆍ군선거관리위원회위원장은 투표함을 개함한 후 투표수를 계산하여 투표록에 기재된 투표용지 교부수와 대조하여야 한다. 이 경우 정당한 사유없이 개표사무를 지연시키는 위원이 있는 때에는 그 권한을 포기한 것으로 보고, 개표록에 그 사유를 기재한다.
