공직선거법 제18조(선거권이 없는 자)
Public Official Election Act, Article 18 (Persons without the Right to Vote)
①선거일 현재 다음 각 호의 어느 하나에 해당하는 사람은 선거권이 없다. <개정 2004.3.12, 2005.8.4, 2015.8.13>
(1) A person who, as of election day, falls under any of the following has no right to vote:

2. 1년 이상의 징역 또는 금고의 형의 선고를 받고 그 집행이 종료되지 아니하거나 그 집행을 받지 아니하기로 확정되지 아니한 사람. 다만, 그 형의 집행유예를 선고받고 유예기간 중에 있는 사람은 제외한다.
2. A person who has been sentenced to imprisonment with or without labor for one year or more and whose sentence has not been fully executed or whose exemption from execution has not become final. However, a person who has been sentenced with a suspended sentence and is within the period of suspension is excluded;
3. 선거범, 「정치자금법」 제45조(정치자금부정수수죄) 및 제49조(선거비용관련 위반행위에 관한 벌칙)에 규정된 죄를 범한 자 또는 대통령ㆍ국회의원ㆍ지방의회의원ㆍ지방자치단체의 장으로서 그 재임중의 직무와 관련하여 「형법」(「특정범죄가중처벌 등에 관한 법률」 제2조에 의하여 가중처벌되는 경우를 포함한다) 제129조(수뢰, 사전수뢰) 내지 제132조(알선수뢰)ㆍ「특정범죄가중처벌 등에 관한 법률」 제3조(알선수재)에 규정된 죄를 범한 자로서, 100만원이상의 벌금형의 선고를 받고 그 형이 확정된 후 5년 또는 형의 집행유예의 선고를 받고 그 형이 확정된 후 10년을 경과하지 아니하거나 징역형의 선고를 받고 그 집행을 받지 아니하기로 확정된 후 또는 그 형의 집행이 종료되거나 면제된 후 10년을 경과하지 아니한 자(형이 실효된 자도 포함한다)
3. An election offender; a person who has committed a crime under Article 45 (Crime of Improperly Giving or Receiving Political Funds) or Article 49 (Penalties for Violations relating to Election Expenses) of the Political Funds Act; or a person who, as President, member of the National Assembly, member of a local council or head of a local government, committed in connection with his or her duties while in office a crime under Articles 129 (Acceptance of Bribes, Advance Acceptance of Bribes) through 132 (Acceptance of Bribes through Good Offices) of the Criminal Act (including where aggravated punishment applies under Article 2 of the Act on the Aggravated Punishment, etc. of Specific Crimes) or Article 3 (Acceptance of Money and Valuables through Good Offices) of the Act on the Aggravated Punishment, etc. of Specific Crimes, for whom five years have not passed since a sentence of a fine of one million won or more became final, or 10 years have not passed since a suspended sentence became final, or 10 years have not passed since it became final that a sentence of imprisonment with labor would not be executed or since the execution of such a sentence ended or was remitted (including a person whose sentence has lapsed);
4. 법원의 판결 또는 다른 법률에 의하여 선거권이 정지 또는 상실된 자

②제1항제3호에서 "선거범"이라 함은 제16장 벌칙에 규정된 죄와 「국민투표법」 위반의 죄를 범한 자를 말한다. <개정 2005.8.4>
(2) In paragraph (1) 3, "election offender" means a person who has committed a crime prescribed in Chapter XVI (Penal Provisions) or a crime in violation of the National Referendum Act.
③「형법」 제38조에도 불구하고 제1항제3호에 규정된 죄와 다른 죄의 경합범에 대하여는 이를 분리 선고하고, 선거사무장ㆍ선거사무소의 회계책임자(선거사무소의 회계책임자로 선임ㆍ신고되지 아니한 사람으로서 후보자와 통모(通謀)하여 해당 후보자의 선거비용으로 지출한 금액이 선거비용제한액의 3분의 1 이상에 해당하는 사람을 포함한다) 또는 후보자(후보자가 되려는 사람을 포함한다)의 직계존비속 및 배우자에게 제263조 및 제265조에 규정된 죄와 이 조 제1항제3호에 규정된 죄의 경합범으로 징역형 또는 300만원 이상의 벌금형을 선고하는 때(선거사무장, 선거사무소의 회계책임자에 대하여는 선임ㆍ신고되기 전의 행위로 인한 경우를 포함한다)에는 이를 분리 선고하여야 한다. <개정 2010.1.25>
(3) Notwithstanding Article 38 of the Criminal Act, where a crime prescribed in paragraph (1) 3 and another crime are concurrent crimes, sentences shall be pronounced separately. Sentences shall also be pronounced separately when imposing imprisonment with labor or a fine of three million won or more for concurrent crimes consisting of a crime under Article 263 or 265 and a crime under paragraph (1) 3 of this Article on an election campaign office manager, the accounting officer of an election campaign office (including a person not appointed and reported as accounting officer of an election campaign office who, in collusion with the candidate, spent as the candidate's election expenses an amount equal to one-third or more of the election expense limit), or a lineal ascendant or descendant or spouse of a candidate (including a person who intends to become a candidate) (for election campaign office managers and accounting officers of election campaign offices, including cases arising from acts committed before their appointment and report).
