공직선거법 제187조(대통령당선인의 결정ㆍ공고ㆍ통지)

①대통령선거에 있어서는 중앙선거관리위원회가 유효투표의 다수를 얻은 자를 당선인으로 결정하고, 이를 국회의장에게 통지하여야 한다. 다만, 후보자가 1인인 때에는 그 득표수가 선거권자총수의 3분의 1 이상에 달하여야 당선인으로 결정한다.

②최고득표자가 2인 이상인 때에는 중앙선거관리위원회의 통지에 의하여 국회는 재적의원 과반수가 출석한 공개회의에서 다수표를 얻은 자를 당선인으로 결정한다.

③제1항의 규정에 의하여 당선인이 결정된 때에는 중앙선거관리위원회위원장이, 제2항의 규정에 의하여 당선인이 결정된 때에는 국회의장이 이를 공고하고, 지체없이 당선인에게 당선증을 교부하여야 한다.

④천재ㆍ지변 기타 부득이한 사유로 인하여 개표를 모두 마치지 못하였다 하더라도 개표를 마치지 못한 지역의 투표가 선거의 결과에 영향을 미칠 염려가 없다고 인정되는 때에는 중앙선거관리위원회는 우선 당선인을 결정할 수 있다.
