공직선거법 제203조(동시선거의 범위와 선거일)

①임기만료일이 같은 지방의회의원 및 지방자치단체의 장의 선거는 그 임기만료에 의한 선거의 선거일에 동시실시한다.

②제35조제2항제2호에 따른 지방자치단체의 장 선거가 다음 각호에 해당되는 때에는 임기만료에 의한 선거의 선거일에 동시실시한다. <개정 1998.4.30, 2000.2.16, 2015.8.13>

③ 임기만료에 따른 국회의원선거 또는 지방의회의원 및 지방자치단체의 장의 선거가 실시되는 연도에는 제35조제2항제1호에 따라 4월 첫 번째 수요일에 실시하는 보궐선거등은 임기만료에 따른 선거의 선거일에 동시 실시한다. 이 경우 4월 30일까지 실시사유가 확정된 보궐선거등은 임기만료에 따른 지방의회의원 및 지방자치단체의 장의 선거의 선거일에 동시 실시한다. <개정 2020.12.29>

④ 임기만료에 따른 대통령선거가 실시되는 연도에는 1월 31일까지 실시사유가 확정된 제35조제2항제1호가목 본문 및 나목에 따른 보궐선거등은 해당 임기만료에 따른 대통령선거의 선거일에 동시 실시한다. <개정 2020.12.29>

⑤ 제35조제2항제1호 각 목(가 목 단서에 따른 보궐선거등은 제외한다)에 따른 보궐선거등의 후보자등록신청개시일 전일까지 대통령의 궐위로 인한 선거 또는 재선거의 실시사유가 확정된 경우 그 보궐선거등은 대통령의 궐위로 인한 선거 또는 재선거의 선거일에 동시 실시한다. <신설 2018.4.6, 2020.12.29>
