공직선거법 제218조의19(재외선거의 투표 절차)

① 재외선거인등은 신분증명서(여권ㆍ주민등록증ㆍ공무원증ㆍ운전면허증 등 사진이 첩부되어 본인임을 확인할 수 있는 대한민국의 관공서나 공공기관이 발행한 증명서 또는 사진이 첩부되고 성명과 생년월일이 기재되어 본인임을 확인할 수 있는 거류국의 정부가 발행한 증명서를 말한다. 이하 이 조에서 같다)를 제시하여 본인임을 확인받은 다음 전자적 방식으로 손도장을 찍거나 서명한 후 투표용지를 받아야 한다. 다만, 재외선거인은 제218조의5제4항에 따라 재외투표관리관이 공고한 서류의 원본을 제시하여 국적 및 본인 여부를 확인받은 다음 투표용지를 받아야 하며, 제시한 서류에 본인임을 확인할 수 있는 사진이 첩부되지 아니한 경우에는 신분증명서를 함께 제시하여야 한다. <개정 2015.12.24>

② 재외투표소의 책임위원등은 투표용지 발급기로 투표용지를 인쇄하여 "책임위원"칸에 자신의 도장을 찍거나 서명(한글성명이 모두 나타나야 한다)한 후 일련번호를 떼지 아니하고 회송용 봉투와 함께 교부한다. <개정 2015.12.24>

③ 투표용지와 회송용 봉투를 받은 재외선거인등은 기표소에 들어가 투표용지에 1명의 후보자(비례대표국회의원선거에서는 하나의 정당을 말한다)를 선택하여 투표용지의 해당 칸에 기표한 다음 그 자리에서 기표내용이 다른 사람에게 보이지 아니하게 접어 이를 회송용 봉투에 넣어 봉함한 후 투표함에 넣어야 한다.

④ 투표용지 발급기의 봉함ㆍ봉인, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다.
