공직선거법 제277조(선거관리경비)

①대통령선거 및 국회의원선거의 관리준비와 실시에 필요한 다음 각호에 해당하는 경비와 지방의회의원 및 지방자치단체의 장의 선거에 관한 사무중 통일적인 수행을 위하여 중앙선거관리위원회 및 시ㆍ도선거관리위원회가 집행하는 경비는 국가가 부담한다. 이 경우 임기만료에 의한 선거에 있어서는 해당 선거의 선거기간개시일이 속하는 연도(제1호 중 선거의 관리준비에 필요한 경비와 제2호에 해당하는 경비는 해당 선거의 선거일 전 180일이 속하는 연도를 포함한다)의 본예산에 편성하여야 하되 늦어도 선거일 전 60일(제1호 중 선거의 관리준비에 필요한 경비는 해당 선거의 선거일 전 120일, 제2호에 해당하는 경비는 해당 선거의 선거일 전 240일)까지 중앙선거관리위원회에 배정하여야 하며, 보궐선거등에 있어서는 그 사무의 수행에 지장이 없도록 그 선거의 실시사유가 확정된 때부터 15일[제197조(選擧의 一部無效로 인한 再選擧)의 재선거에 있어서는 그 사유확정일부터 5일을, 연기된 선거와 재투표에 있어서는 늦어도 선거일공고일전일을 말한다. 이하 이 조에서 같다]까지 중앙선거관리위원회에 배정하여야 한다. <개정 2000.2.16, 2004.3.12, 2025.1.7>

③제1항 및 제2항의 규정에 의하여 국가나 지방자치단체가 선거관리경비를 배정 또는 납부한 후에 이미 그 경비를 배정 또는 납부한 선거와 동시에 선거를 실시하여야 할 새로운 사유가 발생하거나 배정 또는 납부한 경비에 부족액이 발생한 때에는 제4항의 구분에 따른 당해 선거관리위원회의 요구에 의하여 지체없이 추가로 배정 또는 납부하여야 한다.

④제1항 내지 제3항의 규정에 의한 경비외의 경비로서 이 법에 의하여 국가 또는 지방자치단체가 부담하는 경비중 국가가 부담하는 경비는 중앙선거관리위원회의, 시ㆍ도의 의회의원 및 장의 선거에 따른 경비는 시ㆍ도선거관리위원회의, 자치구ㆍ시ㆍ군의 의회의원 및 장의 선거에 따른 경비는 당해 선거구선거관리위원회의 요구에 의하여 당해 선거의 선거일부터 15일안에 당해 선거관리위원회에 배정 또는 납부하여야 한다.
