관세법 시행령 제236조의9(원산지표시위반단속기관협의회)

① 법 제233조의3제1항에서 "원산지표시 위반 단속업무에 필요한 정보교류 등 대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다.

② 법 제233조의3제1항에 따른 원산지표시위반단속기관협의회(이하 이 조에서 "협의회"라 한다)는 위원장 1명을 포함하여 25명 이내의 위원으로 구성한다.

(2) The^ð더 Council카운슬 of어^v브 Agencies에이전시즈 Enforcing엔^f포싱 Origin오^r러전 Marking마킹 Violations^v바이얼레이션즈 under언더 Article아터클 233-3 (1) of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Council"카운슬 in인 this^ð디스 Article)아터클 shall섈 be비 composed컴포우즈드 of어^v브 not낫 more모 than^ð댄 25 members,멤버즈 including인클루딩 one원 chairperson.체어퍼슨

③ 협의회의 위원장은 원산지표시 위반 단속업무를 관장하는 관세청의 고위공무원단에 속하는 공무원 중에서 관세청장이 지정하는 사람이 되고, 위원은 다음 각 호의 사람이 된다.

(3) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Council카운슬 shall섈 be비 a어 person퍼슨 designated데지그네이티드 by바이 the^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service서^v비스 from^f프^r럼 among어멍 public퍼블릭 officials어^f피실즈 of어^v브 the^ð더 Senior시니어 Executive이그제큐티^v브 Service서^v비스 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service서^v비스 in인 charge차지 of어^v브 enforcement엔^f포스먼트 work워크 against어겐스트 origin오^r러전 marking마킹 violations,^v바이얼레이션즈 and앤드 the^ð더 members멤버즈 shall섈 be비 the^ð더 following^f팔로잉 persons:퍼슨즈

④ 위원장은 협의회를 대표하고 사무를 총괄한다. 다만, 부득이한 사유로 위원장이 그 직무를 수행하지 못하는 경우에는 위원장이 미리 지명한 사람이 그 직무를 대행한다. <개정 2020.12.29>

(4) The^ð더 chairperson체어퍼슨 shall섈 represent^r레프^r리젠트 the^ð더 Council카운슬 and앤드 oversee오우^v버시 its잇츠 affairs.어^f페어즈 However,하우에^v버 where웨어 the^ð더 chairperson체어퍼슨 is이즈 unable어네이블 to투 perform퍼^f폼 duties두티즈 for^f포 unavoidable어너^v보이더블 reasons,^r리즌즈 a어 person퍼슨 previously프^r리^v비어슬리 designated데지그네이티드 by바이 the^ð더 chairperson체어퍼슨 shall섈 act액트 on안 the^ð더 chairperson's체어퍼슨즈 behalf.비해^f프

⑤ 협의회의 회의는 정기회의와 임시회의로 구분하되, 정기회의는 반기마다 소집하며, 임시회의는 위원장이 필요하다고 인정하는 경우에 소집한다.

(5) Meetings미팅즈 of어^v브 the^ð더 Council카운슬 shall섈 be비 divided디^v바이디드 into인투 regular^r레귤러 meetings미팅즈 and앤드 extraordinary엑스트^r러오더네^r리 meetings;미팅즈 regular^r레귤러 meetings미팅즈 shall섈 be비 convened컨^v빈드 every에^v버^r리 half해^f프 year,이어 and앤드 extraordinary엑스트^r러오더네^r리 meetings미팅즈 shall섈 be비 convened컨^v빈드 when웬 the^ð더 chairperson체어퍼슨 recognizes^r레커그나이지즈 it잇 as애즈 necessary.네서세^r리

⑥ 협의회의 회의는 위원장이 소집하며 그 의장은 위원장이 된다.

(6) Meetings미팅즈 of어^v브 the^ð더 Council카운슬 shall섈 be비 convened컨^v빈드 by바이 the^ð더 chairperson,체어퍼슨 who후 shall섈 serve서^v브 as애즈 presiding프^r리자이딩 officer.오^f퍼서

⑦ 협의회의 회의는 재적위원 과반수의 출석으로 개의하고, 출석위원 3분의 2 이상의 찬성으로 의결한다.

(7) A어 meeting미팅 of어^v브 the^ð더 Council카운슬 shall섈 be비 convened컨^v빈드 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð디 incumbent인컴번트 members,멤버즈 and앤드 decisions디시전즈 shall섈 be비 made메이드 by바이 the^ð디 affirmative어^f퍼머티^v브 vote^v보우트 of어^v브 at앳 least리스트 two투 thirds^θ써즈 of어^v브 the^ð더 members멤버즈 present.프^r레전트

⑧ 협의회의 사무를 처리하게 하기 위하여 관세청 소속 5급 공무원 1명을 간사로 둔다.

(8) One원 public퍼블릭 official어^f피실 of어^v브 Grade그^r레이드 5 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service서^v비스 shall섈 be비 assigned어사인드 as애즈 secretary세크^r러테^r리 to투 handle핸들 the^ð디 affairs어^f페어즈 of어^v브 the^ð더 Council.카운슬

⑨ 제1항부터 제8항까지에서 규정한 사항 외에 협의회의 운영에 필요한 사항은 협의회의 의결을 거쳐 위원장이 정한다.

(9) Matters매터즈 necessary네서세^r리 for^f포 the^ð디 operation아퍼^r레이션 of어^v브 the^ð더 Council,카운슬 other어^ð더 than^ð댄 those^ð도우즈 prescribed프^r리스크^r라이브드 in인 paragraphs패^r러그^r래^f프스 (1) through^θ쓰^r루 (8), shall섈 be비 determined디터먼드 by바이 the^ð더 chairperson체어퍼슨 after애^f프터 a어 resolution^r레절루션 of어^v브 the^ð더 Council.카운슬
