관세법 시행령 제71조의5(우회덤핑 조사의 개시)

① 무역위원회는 제71조의4제1항에 따른 신청을 받은 경우 신청인이 제출한 자료의 정확성 및 적정성을 검토하여 우회덤핑 조사의 개시 여부를 결정한 후 신청일부터 30일 이내에 그 결과와 다음 각 호의 사항을 재정경제부장관에게 통보해야 한다. 다만, 무역위원회가 필요하다고 인정하는 경우에는 15일의 범위에서 그 기간을 연장할 수 있다. <개정 2025.12.30>

② 무역위원회는 제1항에 따라 우회덤핑 조사의 개시 여부를 결정할 때 그 신청인이 다음 각 호의 어느 하나에 해당하는 경우에는 그 조사 신청을 기각해야 한다.

③ 무역위원회는 우회덤핑 조사의 개시를 결정한 경우에는 결정일부터 10일 이내에 조사개시의 결정에 관한 사항을 조사신청인, 해당 물품의 공급국 정부 및 공급자와 그 밖의 이해관계인에게 통보하고, 관보에 게재해야 한다. 이 경우 해당 물품의 공급자에게는 제71조의4제1항 각 호의 자료를 함께 제공해야 한다.

④ 무역위원회는 우회덤핑 조사대상물품의 품목분류 등에 대해서는 관세청장과 협의하여 선정할 수 있다.
