관세법 제269조(밀수출입죄)
Customs Act, Article 269 (Crime of Smuggling)
① 제234조 각 호의 물품을 수출하거나 수입한 자는 7년 이하의 징역 또는 7천만원 이하의 벌금에 처한다. <개정 2014.12.23>
(1) A person who exports or imports goods under any subparagraph of Article 234 shall be punished by imprisonment with labor for not more than seven years or by a fine not exceeding 70 million won.
② 다음 각 호의 어느 하나에 해당하는 자는 5년 이하의 징역 또는 관세액의 10배와 물품원가 중 높은 금액 이하에 상당하는 벌금에 처한다.
(2) Any of the following persons shall be punished by imprisonment with labor for not more than five years or by a fine not exceeding the greater of 10 times the amount of customs duties or the cost of the goods:
1. 제241조제1항ㆍ제2항 또는 제244조제1항에 따른 신고를 하지 아니하고 물품을 수입한 자. 다만, 제253조제1항에 따른 반출신고를 한 자는 제외한다.
1. A person who imports goods without filing a declaration under Article 241 (1) or (2) or 244 (1): Provided, That a person who has filed a declaration of removal under Article 253 (1) shall be excluded;
2. 제241조제1항ㆍ제2항 또는 제244조제1항에 따른 신고를 하였으나 해당 수입물품과 다른 물품으로 신고하여 수입한 자
2. A person who has filed a declaration under Article 241 (1) or (2) or 244 (1) but imports goods by declaring them as goods different from the imported goods.
③ 다음 각 호의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 물품원가 이하에 상당하는 벌금에 처한다.
(3) Any of the following persons shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding the cost of the goods:
1. 제241조제1항 및 제2항에 따른 신고를 하지 아니하고 물품을 수출하거나 반송한 자
1. A person who exports or returns goods without filing a declaration under Article 241 (1) and (2);
2. 제241조제1항 및 제2항에 따른 신고를 하였으나 해당 수출물품 또는 반송물품과 다른 물품으로 신고하여 수출하거나 반송한 자
2. A person who has filed a declaration under Article 241 (1) and (2) but exports or returns goods by declaring them as goods different from the export or return goods.
