국민기초생활 보장법 시행령 제41조(보장비용의 징수)

① 보장기관은 법 제46조제1항에 따라 부양능력을 가진 부양의무자로부터 보장비용을 징수하는 경우에는 법 제42조제3호에 따른 급여실시비용(이하 이 조에서 "징수대상보장비용"이라 한다)의 범위에서 다음 각 호의 구분에 따라 각각의 부양의무자로부터 징수하되, 그 각각의 부양의무자에 대하여 산출한 금액의 합계액이 징수대상보장비용을 초과하는 경우에는 산출한 금액 간의 비율에 따라 징수대상보장비용을 나눈 금액을 각각의 부양의무자로부터 징수한다. <개정 2015.4.20>

② 법 제46조제2항에 따라 보장기관이 부정수급자에게 징수하는 보장비용은 징수대상보장비용 전액으로 하되, 부정수급자가 2명 이상인 경우에는 부정수급자의 수로 나눈 금액을 각각 징수한다.

③ 보장기관은 보장비용을 징수하는 경우에는 30일 이상의 기한을 정하여 납부통지를 하여야 하며, 부양의무자 또는 부정수급자가 납부기한 내에 납부하지 아니하는 경우에는 30일 이상의 기한을 정하여 납부를 독촉하여야 한다.
