국민연금법 제65조(분할연금과 노령연금의 관계 등)

① 제64조제1항에 따른 분할연금 수급권은 그 수급권을 취득한 후에 배우자였던 자에게 생긴 사유로 노령연금 수급권이 소멸ㆍ정지되어도 영향을 받지 아니한다.

② 수급권자에게 2 이상의 분할연금 수급권이 생기면 제56조에도 불구하고 2 이상의 분할연금액을 합산하여 지급한다. 다만, 2 이상의 분할연금 수급권과 다른 급여(노령연금을 제외한다. 이하 이 항에서 같다)의 수급권이 생기면 그 2 이상의 분할연금 수급권을 하나의 분할연금 수급권으로 보고 본인의 선택에 따라 분할연금과 다른 급여 중 하나만 지급하고 선택하지 아니한 분할연금 또는 다른 급여의 지급은 정지된다.

(2) Where웨어 an앤 entitled엔타이틀드 person퍼슨 comes컴즈 to투 have해^v브 entitlements엔타이털먼츠 to투 two투 or오 more모 split스플릿 pensions,펜션즈 notwithstanding낫위^ð드스탠딩 Article아터클 56, the^ð더 two투 or오 more모 split스플릿 pension펜션 amounts어마운츠 shall섈 be비 added애디드 together터게^ð더 and앤드 paid:페이드 Provided,프^r러^v바이디드 That^ð댓 where웨어 the^ð더 person퍼슨 comes컴즈 to투 have해^v브 entitlements엔타이털먼츠 to투 two투 or오 more모 split스플릿 pensions펜션즈 and앤드 an앤 entitlement엔타이털먼트 to투 another어너^ð더 benefit베너^f핏 (excluding익스클루딩 an앤 old-age오울드-에이지 pension;펜션 hereinafter히^r리내^f프터 the^ð더 same세임 applies어플라이즈 in인 this^ð디스 paragraph),패^r러그^r래^f프 the^ð더 two투 or오 more모 split스플릿 pension펜션 entitlements엔타이털먼츠 shall섈 be비 regarded^r리가디드 as애즈 a어 single싱글 split스플릿 pension펜션 entitlement,엔타이털먼트 only온리 one원 of어^v브 the^ð더 split스플릿 pension펜션 or오 the^ð디 other어^ð더 benefit베너^f핏 shall섈 be비 paid페이드 as애즈 chosen초우즌 by바이 the^ð더 person,퍼슨 and앤드 the^ð더 payment페이먼트 of어^v브 the^ð더 split스플릿 pension펜션 or오 other어^ð더 benefit베너^f핏 not낫 chosen초우즌 shall섈 be비 suspended.서스펜디드

③ 분할연금 수급권자는 제72조제1항에 따른 유족연금을 지급할 때 노령연금 수급권자로 보지 아니한다.

④ 분할연금 수급권자에게 노령연금 수급권이 발생한 경우에는 제56조에도 불구하고 분할연금액과 노령연금액을 합산하여 지급한다.

(4) Where웨어 a어 person퍼슨 entitled엔타이틀드 to투 a어 split스플릿 pension펜션 acquires어콰이어즈 an앤 entitlement엔타이털먼트 to투 an앤 old-age오울드-에이지 pension,펜션 notwithstanding낫위^ð드스탠딩 Article아터클 56, the^ð더 split스플릿 pension펜션 amount어마운트 and앤드 the^ð디 old-age오울드-에이지 pension펜션 amount어마운트 shall섈 be비 added애디드 together터게^ð더 and앤드 paid.페이드
