국민연금법 제97조의2(고액ㆍ상습 체납자의 인적사항 공개)

① 건강보험공단은 이 법에 따른 납부기한의 다음 날부터 1년이 지난 연금보험료, 연체금 및 체납처분비(이하 이 항에서 "연금보험료등"이라 한다)의 총액이 2천만원 이상인 체납자(사업장가입자에 한한다)가 납부능력이 있음에도 불구하고 체납한 경우 체납자의 인적사항(사용자의 인적사항을 말한다) 및 체납액 등(이하 이 조에서 "인적사항등"이라 한다)을 공개할 수 있다. 다만, 체납된 연금보험료등과 관련하여 행정심판 또는 행정소송이 계류 중인 경우나 그 밖에 체납된 금액의 일부 납부 등 대통령령으로 정하는 사유가 있는 경우에는 그러하지 아니하다. <개정 2020.12.29>

② 인적사항등에 대한 공개 여부를 심의하기 위하여 건강보험공단에 보험료정보공개심의위원회를 둔다.

③ 건강보험공단은 보험료정보공개심의위원회의 심의를 거친 인적사항등의 공개대상자에게 공개대상자임을 서면으로 통지하여 소명의 기회를 부여하여야 하며, 통지일부터 6개월이 경과한 후 체납액의 납부 이행 등을 고려하여 공개대상자를 선정한다.
