근로자퇴직급여 보장법 시행령 제16조의9(중소기업퇴직연금기금표준계약서의 승인 및 변경승인 등)

① 근로복지공단은 법 제23조의5제1항에 따라 중소기업퇴직연금기금표준계약서의 승인을 받으려는 경우에는 그 승인 신청서에 다음 각 호의 서류를 첨부하여 고용노동부장관에게 제출해야 한다.

② 근로복지공단은 법 제23조의5제2항 본문에 따라 중소기업퇴직연금기금표준계약서의 변경승인을 받으려는 경우에는 변경 내용 및 사유를 적은 변경승인 신청서에 운영위원회 심의ㆍ의결 결과를 첨부하여 고용노동부장관에게 제출해야 한다.

③ 근로복지공단은 법 제23조의5제2항 단서에 따라 중소기업퇴직연금기금표준계약서의 변경신고를 하려는 경우에는 그 내용을 변경한 날부터 7일 이내에 변경 내용 및 사유를 적은 변경신고서를 고용노동부장관에게 제출해야 한다.

④ 근로복지공단은 제1항부터 제3항까지의 규정에 따라 승인 또는 변경승인을 받거나 변경신고를 한 중소기업퇴직연금기금표준계약서를 다음 각 호의 어느 하나에 해당하는 방법으로 사용자에게 통지해야 한다.
