근로자퇴직급여 보장법 제23조의6(중소기업퇴직연금기금제도의 설정)

① 중소기업의 사용자는 제23조의5에 따른 중소기업퇴직연금기금표준계약서에서 정하고 있는 사항에 관하여 제4조제3항 또는 제5조에 따라 근로자대표의 동의를 얻거나 의견을 들어 공단과 계약을 체결함으로써 중소기업퇴직연금기금제도를 설정할 수 있다.

② 공단은 제23조의5제1항제3호부터 제5호까지 및 제23조의15제1항의 업무수행에 따른 수수료를 사용자 및 가입자에게 부과할 수 있다.

③ 공단은 제23조의5제1항제3호부터 제6호까지의 업무 중 대통령령으로 정하는 업무를 인적ㆍ물적 요건 등 대통령령으로 정하는 요건을 갖춘 자에게 처리하게 할 수 있다.
