금융소비자 보호에 관한 법률 제50조(금융상품판매업자등에 대한 검사)

① 금융상품판매업자등은 그 업무와 재산상황에 관하여 금융감독원장의 검사를 받아야 한다.

② 금융감독원장은 제1항에 따른 검사를 할 때 필요하다고 인정하는 경우에는 금융상품판매업자등에게 업무 또는 재산에 관한 보고, 자료의 제출, 관계인의 출석 및 의견 진술을 요구하거나 금융감독원 소속 직원으로 하여금 금융상품판매업자등의 사무소나 사업장에 출입하여 업무상황이나 장부ㆍ서류ㆍ시설 또는 그 밖에 필요한 물건을 검사하게 할 수 있다.

③ 제2항에 따라 검사를 하는 사람은 그 권한을 표시하는 증표를 지니고 관계인에게 보여 주어야 한다.

④ 금융감독원장은 제1항에 따른 검사를 한 경우에는 그 결과를 금융위원회에 보고하여야 한다. 이 경우 이 법 또는 이 법에 따른 명령이나 처분을 위반한 사실이 있을 때에는 그 처리에 관한 의견서를 첨부하여야 한다.

⑤ 금융감독원장은 「주식회사 등의 외부감사에 관한 법률」에 따라 금융상품판매업자등이 선임한 외부감사인에게 해당 금융상품판매업자등을 감사한 결과 알게 된 정보, 그 밖에 영업행위와 관련되는 자료의 제출을 사용목적에 필요한 최소한의 범위에서 서면으로 요구할 수 있다.

⑥ 금융위원회는 검사의 방법ㆍ절차 등 검사업무와 관련하여 필요한 사항을 정하여 고시할 수 있다.
