기초연금법 시행령 제21조(환수금의 결정ㆍ납부)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제19조제1항 각 호 외의 부분 전단에 따라 기초연금을 환수할 때에는 일시에 전액을 납부하게 하여야 한다. 다만, 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 보건복지부령으로 정하는 바에 따라 환수금을 분할하여 납부하게 할 수 있다.

② 법 제19조제1항 각 호 외의 부분 후단에서 "대통령령으로 정하는 이자"란 3년 만기 정기예금 이자율(이자의 계산 기간 중에 그 이자율이 변동되거나 은행에 따라 이자율이 다른 경우에 적용할 이자율은 해당 연도마다 1월 1일 현재 「은행법」에 따라 설립된 은행 중 전국을 영업구역으로 하는 은행이 적용하는 이자율을 평균한 이자율로 한다)을 적용하여 계산한 이자를 말한다. 이 경우 이자 계산 기간은 거짓이나 그 밖의 부정한 방법으로 기초연금을 지급받은 날이 속하는 달부터 법 제20조제1항에 따라 환수금을 고지한 날이 속하는 달의 전달까지의 개월 수로 하되, 연 단위 복리로 산정한다.

③ 법 제19조제3항에서 "대통령령으로 정하는 금액"이란 3천원을 말한다.
