기초연금법 제13조(기초연금 지급의 결정 등)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제11조에 따른 조사를 한 후 기초연금 수급권의 발생ㆍ변경ㆍ상실 등을 결정한다.

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 기초연금 수급권의 발생 여부를 결정할 때 제11조 또는 제12조에 따라 제공받은 자료ㆍ정보의 전부 또는 일부를 통해 평가한 기초연금 수급희망자와 그 배우자의 소득ㆍ재산 수준이 보건복지부장관이 정하는 기준 이하인 경우에는 관련 조사의 일부를 생략하고 기초연금 수급권의 발생을 결정할 수 있다. <신설 2021.6.8>

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 결정을 한 경우에는 그 결정 내용을 서면으로 그 이유를 구체적으로 밝혀 기초연금 수급권자에게 지체 없이 통지하여야 한다. <개정 2021.6.8>
