기초연금법 제15조(미지급 기초연금)

① 기초연금 수급자가 사망한 경우로서 그 기초연금 수급자에게 지급되지 아니한 기초연금액이 있는 경우에는 그 기초연금 수급자의 사망 당시 생계를 같이 한 부양의무자(배우자와 직계혈족 및 그 배우자를 말한다)는 미지급 기초연금을 청구할 수 있다. 이 경우 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 지체 없이 그 지급 여부를 결정하여 그 부양의무자에게 통지하여야 한다.

② 제1항에 따른 미지급 기초연금의 청구 절차ㆍ방법 및 부양의무자의 인정기준과 지급순위 등에 관하여 필요한 사항은 대통령령으로 정한다.
