노인복지법 제39조의10(실종노인에 관한 신고의무 등)

①누구든지 정당한 사유 없이 사고 등의 사유로 인하여 보호자로부터 이탈된 노인(이하 "실종노인"이라 한다)을 경찰관서 또는 지방자치단체의 장에게 신고하지 아니하고 보호하여서는 아니 된다. <개정 2013.6.4>

②제31조에 따른 노인복지시설(「사회복지사업법」 제2조제4호에 따른 사회복지시설 및 사회복지시설에 준하는 시설로서 인가ㆍ신고 등을 하지 아니하고 노인을 보호하는 시설을 포함한다. 이하 "보호시설"이라 한다)의 장 또는 그 종사자는 그 직무를 수행하면서 실종노인임을 알게 된 때에는 지체 없이 보건복지부령으로 정하는 신상카드를 작성하여 지방자치단체의 장과 제3항제2호의 업무를 수행하는 기관의 장에게 제출하여야 한다. <개정 2011.8.4>

③보건복지부장관은 실종노인의 발생예방, 조속한 발견과 복귀를 위하여 다음 각 호의 업무를 수행하여야 한다. 이 경우 보건복지부장관은 노인복지 관련 법인이나 단체에 그 업무의 전부 또는 일부를 위탁할 수 있다.
