도로교통법 시행령 제5조(부담금의 부과기준 및 환급)

① 특별시장ㆍ광역시장ㆍ제주특별자치도지사 또는 시장ㆍ군수(광역시의 군수는 제외한다. 이하 "시장등"이라 한다)는 법 제3조제4항에 따른 교통안전시설의 철거나 원상회복을 위한 공사 비용 부담금(이하 "부담금"이라 한다)의 금액을 교통안전시설의 파손 정도 및 내구연한 경과 정도 등을 고려하여 산출하고, 그 사유를 유발한 사람이 여러 명인 경우에는 그 유발 정도에 따라 부담금을 분담하게 할 수 있다. 다만, 파손된 정도가 경미하거나 일상 보수작업만으로 수리할 수 있는 경우 또는 부담금 총액이 20만원 미만인 경우에는 부담금 부과를 면제할 수 있고, 2024년 9월 1일부터 2026년 8월 31일까지 발생한 사유로 인한 부담금 총액이 20만원 이상인 경우에는 부담금을 분할하여 납부하게 할 수 있다. <개정 2024.5.28>

② 시장등은 제1항에 따라 부과한 부담금이 교통안전시설의 철거나 원상회복을 위한 공사에 드는 비용을 초과한 경우에는 그 차액을 환급하여야 한다. 이 경우 환급에 필요한 사항은 시장등이 정한다.

③ 법 제4조의2제3항에 따른 무인 교통단속용 장비의 철거나 원상회복을 위한 부담금의 부과 기준 및 환급에 대해서는 제1항과 제2항을 준용한다. 이 경우 "교통안전시설"은 "무인 교통단속용 장비"로, "시장등"은 "시ㆍ도경찰청장, 경찰서장 또는 시장등"으로 본다. <개정 2020.12.31, 2023.6.20>
