Monopoly Regulation and Fair Trade Act, Article 104 (Joint and Several Liability for Payment of Penalty Surcharges)
① 과징금을 부과받은 회사인 사업자가 분할 또는 분할합병되는 경우(부과일에 분할 또는 분할합병되는 경우를 포함한다) 그 과징금은 다음 각 호의 회사가 연대하여 납부할 책임을 진다.
(1) Where an enterpriser that is a company on which a penalty surcharge has been imposed is split or undergoes a split-merger (including where this occurs on the date of imposition), the following companies shall be jointly and severally liable to pay the penalty surcharge:
1. 분할되는 회사
1. The company being split;
2. 분할 또는 분할합병으로 설립되는 회사
2. A company established by the split or split-merger;
3. 분할되는 회사의 일부가 다른 회사에 합병된 후 그 다른 회사가 존속하는 경우 그 다른 회사
3. Where part of the company being split is merged into another company and that other company survives, that other company.
② 과징금을 부과받은 회사인 사업자가 분할 또는 분할합병으로 해산되는 경우(부과일에 해산되는 경우를 포함한다) 그 과징금은 다음 각 호의 회사가 연대하여 납부할 책임을 진다.
(2) Where an enterpriser that is a company on which a penalty surcharge has been imposed is dissolved due to a split or split-merger (including where it is dissolved on the date of imposition), the following companies shall be jointly and severally liable to pay the penalty surcharge:
1. 분할 또는 분할합병으로 설립되는 회사
1. A company established by the split or split-merger;
2. 분할되는 회사의 일부가 다른 회사에 합병된 후 그 다른 회사가 존속하는 경우 그 다른 회사
2. Where part of the company being split is merged into another company and that other company survives, that other company.
