민사소송법 제167조(기일의 통지)

①기일은 기일통지서 또는 출석요구서를 송달하여 통지한다. 다만, 그 사건으로 출석한 사람에게는 기일을 직접 고지하면 된다.

②법원은 대법원규칙이 정하는 간이한 방법에 따라 기일을 통지할 수 있다. 이 경우 기일에 출석하지 아니한 당사자ㆍ증인 또는 감정인 등에 대하여 법률상의 제재, 그 밖에 기일을 게을리 함에 따른 불이익을 줄 수 없다.
