민사소송법 제237조(자격상실로 말미암은 중단)

①일정한 자격에 의하여 자기 이름으로 남을 위하여 소송당사자가 된 사람이 그 자격을 잃거나 죽은 때에 소송절차는 중단된다. 이 경우 같은 자격을 가진 사람이 소송절차를 수계하여야 한다.

②제53조의 규정에 따라 당사자가 될 사람을 선정한 소송에서 선정된 당사자 모두가 자격을 잃거나 죽은 때에 소송절차는 중단된다. 이 경우 당사자를 선정한 사람 모두 또는 새로 당사자로 선정된 사람이 소송절차를 수계하여야 한다.
