민사소송법 제306조(공무원의 신문)

제304조와 제305조에 규정한 사람 외의 공무원 또는 공무원이었던 사람을 증인으로 하여 직무상 비밀에 관한 사항을 신문할 경우에 법원은 그 소속 관청 또는 감독 관청의 동의를 받아야 한다.
