민사소송법 제70조(예비적ㆍ선택적 공동소송에 대한 특별규정)

①공동소송인 가운데 일부의 청구가 다른 공동소송인의 청구와 법률상 양립할 수 없거나 공동소송인 가운데 일부에 대한 청구가 다른 공동소송인에 대한 청구와 법률상 양립할 수 없는 경우에는 제67조 내지 제69조를 준용한다. 다만, 청구의 포기ㆍ인낙, 화해 및 소의 취하의 경우에는 그러하지 아니하다.

②제1항의 소송에서는 모든 공동소송인에 관한 청구에 대하여 판결을 하여야 한다.
