민사집행법 제18조(집행비용의 예납 등)

①민사집행의 신청을 하는 때에는 채권자는 민사집행에 필요한 비용으로서 법원이 정하는 금액을 미리 내야 한다. 법원이 부족한 비용을 미리 내라고 명하는 때에도 또한 같다.

②채권자가 제1항의 비용을 미리 내지 아니한 때에는 법원은 결정으로 신청을 각하하거나 집행절차를 취소할 수 있다.

③제2항의 규정에 따른 결정에 대하여는 즉시항고를 할 수 있다.
