민사집행법 제305조(가처분의 방법)

①법원은 신청목적을 이루는 데 필요한 처분을 직권으로 정한다.

③가처분으로 부동산의 양도나 저당을 금지한 때에는 법원은 제293조의 규정을 준용하여 등기부에 그 금지한 사실을 기입하게 하여야 한다.
