법인세법 시행령 제35조(기부금의 범위)

법 제24조제1항에서 "대통령령으로 정하는 거래"란 특수관계인 외의 자에게 정당한 사유 없이 자산을 정상가액보다 낮은 가액으로 양도하거나 특수관계인 외의 자로부터 정상가액보다 높은 가액으로 매입하는 것을 말한다. 이 경우 정상가액은 시가에 시가의 100분의 30을 더하거나 뺀 범위의 가액으로 한다.
