부정청탁 및 금품등 수수의 금지에 관한 법률 시행령 제24조(인도받은 금품등의 처리)

① 소속기관장, 감독기관, 감사원, 수사기관 또는 국민권익위원회는 법 제9조제2항 단서 또는 같은 조 제6항에 따라 금품등을 인도받은 경우에는 즉시 사진으로 촬영하거나 영상으로 녹화하여야 한다.

② 법 제9조제6항에 따라 금품등을 인도받은 국민권익위원회는 제21조제3항에 따라 준용되는 제12조제1항부터 제3항까지의 규정에 따라 신고를 이첩 또는 송부하는 경우에는 인도받은 금품등과 제1항에 따라 촬영하거나 영상으로 녹화한 기록물을 첨부하여 이첩 또는 송부하여야 한다. 이 경우 이첩 또는 송부한 사실을 금품등을 인도한 자에게 통보하여야 한다.

③ 법 제9조제2항 단서, 같은 조 제6항 또는 이 조 제2항에 따라 금품등을 인도, 이첩 또는 송부받은 소속기관장, 감독기관, 감사원 또는 수사기관은 조사등을 한 결과, 인도ㆍ이첩 또는 송부받은 금품등이 수수 금지 금품등이 아닌 경우에는 다른 법령에 특별한 규정이 있는 경우를 제외하고 금품등을 인도한 자에게 반환한다.

④ 소속기관장, 감독기관, 감사원, 수사기관 또는 국민권익위원회는 인도받은 금품등이 멸실ㆍ부패ㆍ변질 등으로 인하여 제2항 또는 제3항에 따라 처리하기 어렵다고 판단되는 경우에는 금품등을 인도한 자의 동의를 받아 폐기처분한다.
