사립학교법 제66조의3(감사원 조사와의 관계 등)

① 감사원, 공소청과 중대범죄수사청ㆍ경찰, 그 밖의 수사기관은 사립학교 교원에 대한 조사나 수사를 시작하였을 때와 마쳤을 때(공소청의 경우에는 공소제기 여부를 결정한 때를 말한다)에는 10일 이내에 해당 교원의 임용권자에게 그 사실을 통보하여야 한다. <개정 2026.8.4>

② 감사원에서 조사 중인 사건에 대해서는 제1항에 따른 조사 개시 통보를 받은 날부터 징계의결의 요구나 그 밖의 징계 절차를 진행할 수 없다.

③ 공소청과 중대범죄수사청ㆍ경찰, 그 밖의 수사기관에서 수사 중(공소청의 경우에는 해당 사건이 송치된 후 공소제기 여부를 결정하기 전까지를 말한다)인 사건에 대해서는 제1항에 따른 수사 개시 통보를 받은 날부터 징계의결의 요구나 그 밖의 징계 절차를 진행하지 아니할 수 있다. <개정 2026.8.4>
