산업안전보건법 시행령 제45조(공정안전보고서의 제출)

① 사업주는 제43조에 따른 유해하거나 위험한 설비를 설치(기존 설비의 제조ㆍ취급ㆍ저장 물질이 변경되거나 제조량ㆍ취급량ㆍ저장량이 증가하여 별표 13에 따른 유해ㆍ위험물질 규정량에 해당하게 된 경우를 포함한다)ㆍ이전하거나 고용노동부장관이 정하는 주요 구조부분을 변경할 때에는 고용노동부령으로 정하는 바에 따라 법 제44조제1항 전단에 따른 공정안전보고서를 작성하여 고용노동부장관에게 제출해야 한다. 이 경우 「화학물질관리법」에 따라 사업주가 기후에너지환경부장관에게 제출해야 하는 같은 법 제23조에 따른 화학사고예방관리계획서의 내용이 제44조에 따라 공정안전보고서에 포함시켜야 할 사항에 해당하는 경우에는 그 해당 부분에 대한 작성ㆍ제출을 같은 법 제23조에 따른 화학사고예방관리계획서 사본의 제출로 갈음할 수 있다. <개정 2020.9.8, 2025.10.1>

② 제1항 전단에도 불구하고 사업주가 제출해야 할 공정안전보고서가 「고압가스 안전관리법」 제2조에 따른 고압가스를 사용하는 단위공정 설비에 관한 것인 경우로서 해당 사업주가 같은 법 제11조에 따른 안전관리규정과 같은 법 제13조의2에 따른 안전성향상계획을 작성하여 공단 및 같은 법 제28조에 따른 한국가스안전공사가 공동으로 검토ㆍ작성한 의견서를 첨부하여 허가 관청에 제출한 경우에는 해당 단위공정 설비에 관한 공정안전보고서를 제출한 것으로 본다.
