산업안전보건법 제128조의2(휴게시설의 설치)

① 사업주는 근로자(관계수급인의 근로자를 포함한다. 이하 이 조에서 같다)가 신체적 피로와 정신적 스트레스를 해소할 수 있도록 휴식시간에 이용할 수 있는 휴게시설을 갖추어야 한다.

② 사업주 중 사업의 종류 및 사업장의 상시 근로자 수 등 대통령령으로 정하는 기준에 해당하는 사업장의 사업주는 제1항에 따라 휴게시설을 갖추는 경우 크기, 위치, 온도, 조명 등 고용노동부령으로 정하는 설치ㆍ관리기준을 준수하여야 한다.
