상법 제83조(계약의 해지)

①조합계약으로 조합의 존속기간을 정하지 아니하거나 어느 당사자의 종신까지 존속할 것을 약정한 때에는 각 당사자는 영업연도말에 계약을 해지할 수 있다. 그러나 이 해지는 6월전에 상대방에게 예고하여야 한다.

②조합의 존속기간의 약정의 유무에 불구하고 부득이한 사정이 있는 때에는 각 당사자는 언제든지 계약을 해지할 수 있다.
