성매매알선 등 행위의 처벌에 관한 법률 제12조(보호사건의 처리)

① 검사는 성매매를 한 사람에 대하여 사건의 성격ㆍ동기, 행위자의 성행(性行) 등을 고려하여 이 법에 따른 보호처분을 하는 것이 적절하다고 인정할 때에는 특별한 사정이 없으면 보호사건으로 관할법원에 송치하여야 한다.
