성매매알선 등 행위의 처벌에 관한 법률 제8조(신뢰관계에 있는 사람의 동석)

① 법원은 신고자등을 증인으로 신문할 때에는 직권으로 또는 본인ㆍ법정대리인이나 검사의 신청에 의하여 신뢰관계에 있는 사람을 동석하게 할 수 있다.

② 검사 및 수사기관은 신고자등에 대하여 「형사소송법」 제245조의13에 따른 사실관계 확인이나 면담(이하 "사실관계 확인이나 면담"이라 한다) 또는 조사를 할 때에는 직권으로 또는 본인ㆍ법정대리인의 신청에 의하여 신뢰관계에 있는 사람을 동석하게 할 수 있다. <개정 2026.9.29>

③ 법원, 검사 또는 수사기관은 미성년자, 사물을 변별하거나 의사를 결정할 능력이 없거나 미약한 사람 또는 대통령령으로 정하는 중대한 장애가 있는 사람에 대하여 제1항 및 제2항에 따른 신청을 받은 경우에는 재판, 사실관계 확인이나 면담 또는 수사에 지장을 줄 우려가 있는 등 특별한 사유가 없으면 신뢰관계에 있는 사람을 동석하게 하여야 한다. <개정 2023.12.29, 2026.9.29>

④ 제1항부터 제3항까지의 규정에 따라 신문, 사실관계 확인이나 면담 또는 조사에 동석하는 사람은 진술을 대리하거나 유도하는 등의 행위로 수사나 재판에 부당한 영향을 끼쳐서는 아니 된다. <개정 2026.9.29>
