스토킹범죄의 처벌 등에 관한 법률 제4조(긴급응급조치)

① 사법경찰관은 스토킹행위 신고와 관련하여 스토킹행위가 지속적 또는 반복적으로 행하여질 우려가 있고 스토킹범죄의 예방을 위하여 긴급을 요하는 경우 스토킹행위자에게 직권으로 또는 스토킹행위의 상대방이나 그 법정대리인 또는 스토킹행위를 신고한 사람의 요청에 의하여 다음 각 호에 따른 조치를 할 수 있다. <개정 2023.7.11>

② 사법경찰관은 제1항에 따른 조치(이하 "긴급응급조치"라 한다)를 하였을 때에는 즉시 스토킹행위의 요지, 긴급응급조치가 필요한 사유, 긴급응급조치의 내용 등이 포함된 긴급응급조치결정서를 작성하여야 한다.
