실용신안법 제27조(디자인권의 존속기간 만료 후의 통상실시권)

① 실용신안등록출원일 전 또는 실용신안등록출원일과 같은 날에 출원되어 등록된 디자인권이 그 실용신안권과 저촉되는 경우 그 디자인권의 존속기간이 만료될 때에는 그 디자인권자는 그 디자인권의 범위에서 그 실용신안권에 대하여 통상실시권을 가지거나 그 디자인권의 존속기간 만료 당시 존재하는 그 실용신안권의 전용실시권에 대하여 통상실시권을 가진다.

② 실용신안등록출원일 전 또는 실용신안등록출원일과 같은 날에 출원되어 등록된 디자인권이 그 실용신안권과 저촉되는 경우 그 디자인권의 존속기간이 만료될 때에는 다음 각 호의 어느 하나의 권리를 가진 자는 원(原)권리의 범위에서 그 실용신안권에 대하여 통상실시권을 가지거나 그 디자인권의 존속기간 만료 당시 존재하는 그 실용신안권의 전용실시권에 대하여 통상실시권을 가진다.

③ 제2항에 따라 통상실시권을 가진 자는 실용신안권자 또는 전용실시권자에게 상당한 대가를 지급하여야 한다.
