아동복지법 제61조(보조금의 반환명령)
Child Welfare Act, Article 61 (Orders to Return Subsidies)
국가 또는 지방자치단체는 아동복지시설의 장 등 보호수탁자, 보장원의 장, 가정위탁지원센터의 장, 아동복지단체의 장이 다음 각 호의 어느 하나에 해당하는 경우에는 이미 교부한 보조금의 전부 또는 일부의 반환을 명할 수 있다. <개정 2016.3.22, 2019.1.15, 2020.12.29>
The State or local governments may order persons entrusted with protection, such as heads of child welfare facilities, the head of the Center, heads of family foster care support centers, and heads of child welfare organizations, to return all or part of subsidies already granted if they fall under any of the following:
1. 보조금의 교부조건을 위반한 경우
1. Where they have violated the conditions for granting the subsidies;
2. 거짓이나 그 밖의 부정한 방법으로 보조금의 교부를 받은 경우
2. Where they have received the subsidies by fraudulent or other unlawful means;
3. 아동복지시설의 경영에 관하여 개인의 영리를 도모하는 행위를 한 경우
3. Where they have sought personal profit in managing a child welfare facility;
4. 보조금의 사용잔액이 있는 경우
4. Where there is an unused balance of the subsidies;
5. 이 법 또는 이 법에 따른 명령을 위반한 경우
5. Where they have violated this Act or orders issued under this Act.
