유아교육법 제31조(휴업 및 휴원 명령)

①관할청은 재해 등의 긴급한 사유로 정상적인 교육이 불가능하다고 인정하는 경우에는 원장에게 휴업을 명할 수 있다.

③관할청은 원장이 제1항에 따른 명령에도 불구하고 휴업을 하지 아니하거나 특별히 긴급한 사유가 있는 경우에는 휴원처분을 할 수 있다. <개정 2010.3.24>

④제1항과 제2항에 따라 휴업된 유치원은 휴업기간중 해당 유치원에서 교육받는 유아의 등교와 교육이 정지되며, 제3항에 따라 휴원된 유치원은 휴원기간중 단순한 관리업무 외에 유치원의 모든 기능이 정지된다. <개정 2010.3.24>
