자본시장과 금융투자업에 관한 법률 시행령 제388조(분담금의 분담요율ㆍ한도 등)

① 법 제442조제1항에 따른 분담금의 분담요율은 다음 각 호에서 정하는 비율의 범위에서 금융위원회가 정하여 고시하는 비율로 한다. 이 경우 증권신고서 수리 후에 발행가액총액이 변경되는 때에는 그 변경된 발행가액총액을 기준으로 한다.

② 법 제442조제1항에 따른 분담금의 한도 및 한도를 초과하여 징수한 분담금의 반환에 관하여는 「금융위원회의 설치 등에 관한 법률 시행령」 제12조제3항 및 제4항에서 정하는 바에 따른다.

③ 제1항 및 제2항에서 정한 사항 외에 분담금의 징수 방법 및 반환 등에 관하여 필요한 사항은 금융위원회가 정하여 고시한다.
