자본시장과 금융투자업에 관한 법률 제389조(거래의 종결)

① 거래소는 회원이 거래의 정지를 당하거나 그 자격을 상실한 경우에는 그 회원 또는 다른 회원으로 하여금 해당 증권시장 또는 파생상품시장에서 행한 매매거래를 종결시켜야 한다. 이 경우 자격을 상실한 회원은 매매거래를 종결시키는 범위에서 회원의 자격을 가진 것으로 본다.

② 제1항에 따라 거래소가 다른 회원으로 하여금 해당 매매거래를 종결시키는 경우에는 그 회원과 다른 회원 사이에 위임계약이 체결된 것으로 본다.
